Dementia victim will not be charged with alleged nursing home assault

WINDSOR—A 77-year-old man will not be charged in connection with an alleged Feb. 16 assault against an 84-year-old woman in the Alzheimer’s ward of a Windsor nursing home.
Isle of Wight County Commonwealth’s Attorney Wayne Farmer determined the man did not have the mental capacity to commit the alleged crime at Consulate Health Care on Courthouse Highway.
Farmer reviewed the case, which included interviews with the doctors caring for the man. The evidence concluded he has dementia with behavioral disturbance, according to Windsor Police Chief Vic Reynolds. A doctor who evaluated the man found him to be confused and disoriented.
The man punched the woman when she was in her bed. She was taken to Sentara Obici Hospital in Suffolk.
The man has been taken to another facility.
