In execution of a certain deed of trust dated November 05, 2001, in the original principal amount of $130,900.00 recorded in the Clerk’s Office, Circuit Court for Southampton County, Virginia, in Instrument No. 010003799, the undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Southampton County, 22350 Main Street, Courtland, Virginia 23837 on April 14, 2015 at 2:01 pm the property described in said deed of trust, located at the above address and more particularly described as follows: ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND LYING, SITUATE AND BEING IN THE CITY OF FRANKLIN, SOUTHAMPTON COUNTY, VIRGINIA, AS SHOWN ON “PLAT SHOWING SUBDIVISION OF PROPERTY BELONGING TO MRS. JAMES IRVING BEALE, JR., ET ALS, FRANKLIN DISTRICT, SOUTHAMPTON CO. VIRGINIA, SCALE 1″=100″, ” DATED DECEMBER 3, 1955, MADE BY J.E. HENRY REGISTERED ENGINEER, WHICH SAID PLAT IS RECORDED IN THE CLERK’S OFFICE OF THE CIRCUIT COURT OF SOUTHAMPTON COUNTY, VIRGINIA IN PLAT BOOK 6, PAGE 159, SAID LOT BEING DESIGNATED AS LOT #12, MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS: “BEGINNING AT A POINT ON THE WEST SIDE OF SOUTHAMPTON ROAD AT A POINT WHERE AN IRON PIN IS DRIVEN INTO THE GROUND, A CORNER FOR THE WITHIN DESCRIBED LOT OR PARCEL OF LAND AND LOT #2, THENCE NORTH 5 DEGREES 24′ WEST 100 FEET TO A POINT WHERE AN IRON PIN IS DRIVEN INTO THE GROUND; THENCE SOUTH 84 DEGREES 36′ WEST 270 FEET TO A POINT WHERE AN IRON PIN IS DRIVEN INTO THE GROUND; THENCE SOUTH 5 DEGREES 24′ EAST 100 FEET TO A POINT WHERE AN IRON PIN IS DRIVEN INTO THE GROUND; THENCE NORTH 84 DEGREES 36′ EAST 270 FEET TO THE IRON PIN AT THE POINT OF BEGINNING, ALL AS SHOWN ON THE AFORESAID PLAT.” TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
