Default having been made in the terms of a certain Deed of Trust dated September 13, 2007, in the original principal amount of $100,000.00 and recorded in the Clerk’s Office of the Circuit Court of the County of Southampton, Virginia as Instrument No. 070003945, and modified by Loan Modification Agreement recorded as Instrument Number 090002247, the undersigned Substitute Trustee will sell at public auction on March 25, 2015, at 1:00 p.m., in front of the building housing the Southampton County Circuit Court, 22350 Main Street, Courtland, VA, the property designated as commencing at the northwest corner of the Bryant residence lot, formerly Sobrell`s lot on Beaton Avenue, and thence running a westerly course along Beaton Avenue 75 feet; thence southerly course 210 feet to the residence lot of Draper; thence an easterly course along said Draper lot 75 feet to the southwest corner of the said Bryant lot 210 feet to the point of beginning. PARCEL TWO: Commencing at the northwest corner of a lot owned by the parties of the first part known as the Britt residence on Beaton Avenue and running westerly direction 6 feet and 10 inches to an iron stake at a point designated as the northeast intersection of East Street after completion and said Beaton Avenue; thence a southerly direction in a straight line 210 feet to an iron stake at the lands of Draper: thence East along said Draper line 6 feet and 10 inches to an iron stake at the southwest corner of the aforesaid lot owned by the parties of the first part, and thence in a northerly direction along the said Britt residence lot 210 feet to the point of beginning. Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises. The property will be sold subject to the right of redemption of the Internal Revenue Service.
TERMS: CASH. A deposit of $10,000.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $10,000.00 of cash will be accepted. The successful bidder’s deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee’s Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee’s Sale, available for review on the Foreclosure Sales page of www.glasserlaw.com, outlining additional terms of sale and settlement.
