In execution of a certain deed of trust dated March 18, 1993, in the original principal amount of $68,749.99 recorded in the Clerk’s Office, Circuit Court for Southampton County, Virginia, in Deed Book 371 Page 644, the undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Southampton County, 22350 Main Street, Courtland, Virginia 23837 on June 30, 2015 at 2:01 pm the property described in said deed of trust, located at the above address and more particularly described as follows: ALL THAT CERTAIN LOT, PIECE OR PARCEL OF REAL PROPERTY SITAUTED IN FRANKLIN MAGISTERIAL DISTRICT, SOUTHAMPTON COUNTY, VIRGINIA, ON THE WESTERN SIDE OF THE ROAD LEADING FROM THE TOWN OF FRANKLIN TO SOUTH QUAY, KNOWN AS VIRGINIA STATE ROUTE NUMBERED 714, AND DESIGNATED ON A CERTAIN PLAT ENTITLED “SECTION NO. ONE JESSE MCCLENNY SUBDIVISION, ON ROUTE 714 SOUTH OF FRANKLIN, FRANKLIN DISTRICT, SOUTHAMPTON COUNTY, VIRGINIA” WHICH PLAT, MADE BY J. E. HENRY, REGISTERED ENGINEER, AND DATED SEPTEMBER 5, 1959, IS OF RECORD IN THE CLERK’S OFFICE OF THE CIRCUIT COURT OF SOUTHAMPTON COUNTY, VIRGINIA, AS “TRACT A TO BE CONVEYED TO WILLIE ELIJAH BEALE”, AND DESCRIBED: BEGINNING AT AN IRON PIN IN THE WESTERN BOUNDARY OF SAID VIRGINIA STATE ROUTE #714, A CORNER FOR OTHER PROPERTY ALREADY OWNED BY WILLIE ELIJAH BEALE, THE SAID TRACT A, AND LOT #1 ON SAID PLAT; THENCE NORTH 75 DEGREES 54 MINUTES WEST OF A DISTANCE OF 314.39 FEET TO A PINE STUMP, A CORNER FOR THE SAID TRACT A AND OTHER PROEPRTY ALREADY OWNED BY WILLIE ELIJAH BEALE; THENCE SOUTH 81 DEGREES 29 MINUTES EAST A DISTANCE OF 225 FEET TO A POINT, A CORNER FOR THE SAID TRACT A, AND OTHER PROPERTY OWNED BY THE GRANTORS HEREIN; THENCE NORTH 63 DEGREES 15 MINUTES EAST A DISANCE OF 332.4 FEET TO THE POINT OF BEGINNING. TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
