the original principal amount of
$180,310.00, dated September 23,
2011 recorded in the Clerk’s Office
of the Circuit Court of the
Southampton County, Virginia, in
Document No. 110002263, at
Page 127, default having occurred
in the payment of the Note thereby
secured and at the request of the
holder of said Note, the undersigned
Substitute Trustee will offer
for sale at public auction at the
entrance to the Circuit Court of
Southampton County located in
Courtland, on April 27, 2016 at
3:15 PM the property described in
said deed, located at the above address
and briefly described as:
Parcel 1: Beginning at a point on
the south side of Highway #684 at
a point, a corner for this lot and
other land of W. M. Beale, III, and
running thence with the line of
other property of W. M. Beale, III,
south 20 51′ east 320 feet to a
point, a corner for the within described
property and other property
of W. M. Beale, III; thence
south 6909: west along the line of
other property owned by W. M.
Beale, III, 180 feet to a point, a
corner for the within described
property, other property of W. M.
Beale, III and a lot to be conveyed
by deed of even date herewith;
thence north 20 51′ west 220 feet
to a point on the south side of Virginia
State Route #684; a corner
for the within described property,
lot #3 and said Route 684; thence
north 69 09′ east along the southern
boundary of said Route 684,
180 feet to a point, the point of beginning,
and:
Parcel 2: Beginning at a point, a
corner for the within described
easement, lots 4, 3, 2 and a certain
45 by 180 foot lot conveyed
by deed dated February 14, 1961,
of record in Deed Book 151 at
page 335; thence south 20 51′
east 5 feet plus along the line of
said 45 foot by 180 foot lot to a
point; thence south 15 00′ west
parallel to the southeastern
boundaries of lots 4, 5, 6 and 7 a
distance of about 318 feet to appoint;
thence north 7500′ west a
distance of 5 feet to a point, the
southern corner of lot #7; thence
along the southeastern boundaries
of lots #7, #6, #5 and #4 North
15 00 east, 320 feet to a point, the
point of beginning, with improvements
thereon.
Subject to any and all covenants,
conditions, restrictions, easements,
and all other matters of record
taking priority over the Deed
of Trust, if any, affecting the aforesaid
property.
TERMS OF SALE: CASH: A deposit
of $20,000.00 or 10% of the
sales price, whichever is lower,
cash or certified check will be required
at the time of sale, but no
more than $10,000.00 of cash will
be accepted, with settlement within
fifteen (15) days from the date
of sale. Sale is subject to post sale
confirmation that the borrower did
not file for protection under the
U.S. Bankruptcy Code prior to the
sale, as well as to post-sale confirmation
of the status of the loan
with the loan servicer including,
but not limited to, determination of
whether the borrower entered into
any repayment agreement, reinstated
or paid off the loan prior to
the sale. In any such event, the
sale shall be null and void, and the
Purchasers sole remedy, in law or
equity, shall be the return of his
deposit without interest. Additional
terms may be announced at the
time of sale. Pursuant to the Federal
Fair Debt Collection Practices
Act, we advise you that this firm is
