In execution of a certain deed of trust dated September 12, 2006, in the original principal amount of $235,204.98 recorded in the Clerk’s Office, Circuit Court for Southampton County, Virginia as Instrument No. 060004125 , the undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Southampton County, 22350 Main Street, Courtland, Virginia 23837 on May 24, 2016, at 2:00 PM, the property described in said deed of trust, located at the above address, and more particularly described as follows: ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND LYING, BEING SITUATE IN CAPRON MAGISTERIAL DISTRICT, SHOWN TO CONTAIN 1.51 ACRES AS SHOWN ON THAT CERTAIN PLAT ENTITLED “PLAT SHOWING SURVEY FOR GREGORY ALLEN HARMON & COLLEEN MICHELLE HARMON, CAPRON MAGISTERIAL DISTRICT, SOUTHAMPTON COUNTY, VIRGINIA, SCALE 1 INCHES – 100 FEET, MAY 2001 SAID PLAT HAVING BEEN PREPARED BY S.V. CAMP III AND ASSOCIATES, COURTLAND, VIRGINIA, A COPY OF WHICH PLAT IS ATTACHED TO RECORDED WITH THE DEED AS INSTRUMENT NUMBER 010001949, IN THE CLERK`S OFFICE OF THE CIRCUIT COURT OF SOUTHAMPTON COUNTY, VIRGINIA, AND TO WHICH PLAT REFERENCE IS HEREBY MADE FOR A MORE PARTICULAR METES AND BOUNDS DESCRIPTION OF SAID LAND BEING HEREIN CONVEYED. THIS REAL STATE IS CONVEYED SUBJECT TO ALL RECORDED EASEMENTS, CONDITIONS, RESTRICTIONS AND AGREEMENTS THAT LAWFULLY APPLY TO THE REAL STATE OR ANY PART THEREOF. TAX MAP OR PARCEL ID NO. 73-36-E. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
